1. Acceptance of Terms
By creating an account, installing the Phishgate browser extension, or otherwise accessing the Phishgate platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
Phishgate is a software-as-a-service (SaaS) platform that provides phishing detection and threat monitoring capabilities for organizations. The Service consists of:
- A browser extension installed on employee devices that detects and blocks phishing URLs in real time.
- An administrative dashboard enabling security administrators to review phishing events, manage domain allow/blocklists, and configure detection policies.
- A REST API that powers both the browser extension and the dashboard.
3. Accounts and Access
You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately at [email protected] of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulations.
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
- Interfere with the integrity or performance of the Service or its underlying infrastructure.
- Use the Service to monitor individuals without their knowledge or consent, beyond the scope of your organization's lawful IT security monitoring policies.
- Resell, sublicense, or otherwise commercialize access to the Service without our written consent.
5. Subscription and Payment
Access to the Service is provided on a subscription basis. Fees are billed in advance on a monthly or annual cycle as chosen at sign-up. All fees are non-refundable except as required by applicable law. We reserve the right to modify pricing with 30 days' advance notice.
6. Intellectual Property
All rights, title, and interest in and to the Service — including software, algorithms, trademarks, and documentation — are and remain the exclusive property of Phishgate GmbH. These Terms do not grant you any rights to use our trademarks, logos, or brand features.
You retain ownership of your organization's configuration data. By using the Service, you grant us a limited license to process that data solely to provide the Service.
7. Data Processing
Our handling of personal data is governed by our Privacy Policy. For enterprise customers requiring a Data Processing Agreement (DPA) under GDPR Article 28, please contact us at [email protected].
8. Disclaimers and Limitation of Liability
The Service is provided “as is” and “as available”. We make no warranties, express or implied, as to the completeness or accuracy of phishing detection results. Phishgate shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising under these Terms shall not exceed the fees paid by you to Phishgate in the three months preceding the event giving rise to the claim.
9. Termination
Either party may terminate the subscription at the end of the current billing period. We may suspend or terminate your access immediately if you breach these Terms, engage in fraudulent activity, or fail to pay fees when due. Upon termination, your data will be retained for 90 days before permanent deletion, in accordance with our Privacy Policy.
10. Governing Law
These Terms are governed by the laws of [Country/Jurisdiction], without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of [City], [Country].
11. Changes to These Terms
